Holtec International To Appeal Water Discharge Decision

The owner of the former Pilgrim Nuclear Power Station plans to appeal the denial to discharge treated water into Cape Cod Bay.

Holtec International confirmed this week it will appeal the decision by the state Department of Environmental Protection to disallow the discharge of radioactive water into the bay.

The DEP’s ruling stemmed from the bay’s designation as protected under the Ocean Sanctuaries Act.

A Holtec spokesperson indicated their attorneys will argue the permit pre-dates the act. Legal experts believe the company could argue that federal law allows discharge from nuclear plants within limits, and that supersedes the state.

The deadline for appeal is Monday.
