The Town of Barnstable has filed a motion to dismiss a lawsuit that challenges the town’s massive, 30-year comprehensive wastewater management plan.
The suit was filed against the town by the Conservation Law Foundation, claiming the Barnstable water pollution control facility - that’s a treatment plant in Hyannis - violates the Federal Clean Water act.
The town says this claim is false, adding the claims are not upheld by the U.S. Supreme Court or the EPA.
