Barnstable Police responded to the parking lot of the Cape Cod Mall Wednesday afternoon for what witnesses described as an erratic driver striking landscape boulders and operating recklessly.

Barnstable Officer John O’Hare arrived on scene and observed the suspect in a van with Florida license plates.

When the officer attempted to stop the van, it left the marked lane of travel and ended up on a parking lot island before stopping.

The driver, 49 year old Darin Selby of Sandwich, was arrested and charged with O.U.I. liquor – 3rd offense, operating to endanger, operating after license suspension and operating with an open container of alcohol.

While booking selby, police discovered he was a fugitive from justice from Naples, Florida, on charges related to a 3rd conviction for petty theft.

He will be arraigned in Barnstable District Court Thursday.
