The Brewster Select Board says it will file a lawsuit to stop Eversource from using herbicide under its power lines.
The board says it has actively opposed the Massachusetts Department of Agricultural Resources granting permission to Eversource for the vegetation management since 2015, but the town has not yet been subject to the activity.
That is scheduled to change this year, and the Select Board says it will file the litigation against the state agency.
Environmentalists have asked the power company to stop the herbicide application on the Cape over concerns about its effect on the water supply.
