The State Supreme Court has upheld the decision of a Barnstable County Judge not to suppress evidence obtained from an Automatic License Plate Reader on the Bourne and Sagamore Bridges.
Jason McCarthy was indicted by a grand jury on drug charges and contended that his privacy was violated when his license plates were recorded when he went across the bridge.
He was arrested on drug charges.
The high court ruled that while McCarthy had a right to privacy it was not invaded by his public movements over the bridge at the data reader.
