The battle between Dennis and Yarmouth over a proposed new middle school for the DY Regional School District is headed to court.
The Yarmouth Board of Selectmen has instructed its legal counsel to initiate a lawsuit with the DY Regional District School Committee seeking an invalidation of the process used by the committee to obtain approval for the loan for a new school.
The building of that school was approved by 29 votes collectively, but the outcome was different in the two towns with Dennis voters supporting the new school and Yarmouth residents opposed.
In addition, Yarmouth voters rejected a near $49 million debt exclusion to cover the town’s share of the school while Dennis voters Okayed a debt exclusion of just over $24 million for its share of the cost.
